This course addresses a fundamental issue that confronts patent practitioners. It shows that identifying the ethical rules which will apply during prosecution or federal court litigation can, by itself, be a complicated task, one that lawyers must undertake with little guidance. Topics include choice of law, proposed new rules, taking an interest in patents in lieu of fees, imputation of law to client, "Willful Blindness" and negligent inequitable conduct, conflicts in patent practice and use of undercover investigators.
